1. General

This software license agreement (hereafter "this agreement") is a legal agreement between you i.e., the end user or customer (either an individual or a legal entity) and A Alexander Taylor (Dalton Square Medical). The copyright of this software (hereafter "the SOFTWARE" or "contentserver") and its associated documentation (including any files, source code, images and text incorporated into the software) as well as any accompanying written material is owned by A Alexander Taylor (Dalton Square Medical), located at P.O. Box 6587, Bournemouth, BH4 0BL and is protected by UK copyright laws and international treaties. By installing, or otherwise using this software, you agree with the owner to be bound by the terms and conditions of this agreement, which will govern your use of the software. If you do not agree to this agreement, do not install or use this software. Any offence against the agreement will be prosecuted to the fullest extent of the law. You will be held responsible for any employees or users who receive the software and in turn make unauthorized copies. Should one of the provisions of this Agreement be or become ineffective, this shall not affect the validity of the remainder of this Agreement.

2. License

A Alexander Taylor (Dalton Square Medical) grants, and you accept, a non-transferable and nonexclusive license to use the software on the following terms and conditions, according to the license type that you have acquired:

Definition of a Single User / Single Student Nurse version
A single user license version, allows an individual to use the product, for their own personal use, in their home environment. The license does not allow the lending out or rental of this product. Nor does it permit the use of this product within an institution, such as a hospital or university. Such a use is in breach of copyright and in breach of the single user licence terms and conditions.

Definition of a Single Library licence version
A single library licence allows an institution, such as a hospital or university to use the product as a reference text/teaching aid within their building or buildings. The license does not allow the lending out or rental of this product. Such a use is in breach of copyright and in breach of the single licence terms and conditions.

Definition of Library License version - Multi
A Library License Multi version, allows an institution such as a hospital or university to use the product as a reference text/teaching aid within their building or buildings. It allow permits the lending out, of the 10 single user versions included in the package. The licence, does not permit the rental of this product. Such a use is in breach of copyright and in breach of the terms and conditions.

Definition of a Local Area Network License
A local area network (LAN) is a network that connects computers and other devices in a relatively small area, typically a single building or a group of buildings or hospital or university campus

- You may use the software in an intranet website with non-anonymous and anonymous users. This license does not allow access for users to connect from either a wide area network (WAN), or outside the firewall.

3. Exceptions and Obligations

Installation of the software onto a system or the playing of our DVDs on the hardware that you use means that you have accepted and agreed to the terms that govern the use of the copyrighted software and DVDs.

You are not permitted to:
- make copies of, or distribute parts of the software or DVD;
- rent, lease, sub-license, loan, copy, modify, alter, adapt, merge, translate, reverse engineer, decompile or repackage the software/DVD into another product, or to disassemble it or create derivate works, based on the whole, or any part of the software or its associated documentation;
- copy the software/DVD for the purpose of illegal distribution or loading onto systems owned by another individual or company.

4. Terms

The agreement is effective until you terminate it by destroying the software/DVD and its documentation. The agreement will also be terminated, if you fail to abide by its terms. Upon termination, you agree to destroy all the software, and its documentation, including any software/DVD stored on the hard disk of any server/computer under your control.

5. Ownership

The software/DVD is licensed to you. You do not own it. The owner shall at all time retain ownership of the software/DVD as well as all subsequent copies thereof, regardless of form and storage medium. The owner also retains the title, and all proprietary rights to the software, including, but not limited to, all patent, copyright, trade secret, service, service marks, registered service marks, trademark or registered trademark right.
You agree to protect the confidentiality of the software/DVD, the documentation as well as any accompanying written materials. You agree that you will not provide the software/DVD or documentation nor any accompanying written materials nor divulge any proprietary information of A Alexander Taylor (Dalton Square Medical) to any person, other than your employees, without the prior consent of A Alexander Taylor (Dalton Square Medical). You shall use the best effort to see that any user of the software/DVD licensed hereunder complies with all provisions and prohibitions this agreement.

6. Disclaimer of warranty

The Owner does not guarantee the following: That the software/DVD will be free from bugs, errors, or omissions, that it will perform without interruption, that the software/DVD will meet your requirements, that the operation of the software/DVD will be uninterrupted or error-free, that defects in the software will be corrected, or that new releases and/or upgrades of the software/DVD will be provided. The software/DVD, any information, codes, and/or executables provided, is supplied "as is" without warranty of any kind. To the maximum extent permitted by applicable law, the owner further disclaims all warranties either expressed or implied, including, but not limited to, the warranties of merchantability, fitness for particular purpose and noninfringement. You accept any and all risk associated with the use or performance of the software/DVD and documentation. To the maximum extent permitted by applicable law, the owner shall not be liable for any damages whatsoever, including, but not limited to, direct, indirect, or incidental loss of business profits, special damages arising from the use (or inability to use) the software/DVD, or from errors or deficiencies in it, whether caused by damages. In no event shall the owner's liability exceed the amount paid by you for the software/DVD. Should your state/jurisdiction not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

7. Law

This agreement shall be governed by English laws and regulations and international treaties.

8. Local Area Network/Intranet Version Annual Fee

A annual fee of £250 is applicable from 12 months of receipt of the original invoice. This entitles you to support and file replacement in the event of data loss or file corruption, advance notice and discounts on new products. By purchasing this product you are liable for this as outlined in the terms above.
